Case Highlights

PP v CPS [2024] SGHC 64 (Criminal Matter – Reformative Training for Young Offenders Charged with Serious Offences)

Mato was lead counsel in a case involving a young individual charged with the serious offence of rape. This was a novel case as there were no other reported decisions from the High Court on the availability of reformative training for young offenders charged with rape. Mato successfully argued that reformative training should continue to be a sentencing option for serious offences including rape and the Court sentenced the offender to reformative training.

PP v Lim Boon Chye Victor and Murugesan Srinivasan

Acted as assisting counsel together in defending directors of a company specialising in the manufacturing of floating production storage and offloading (FPSO) components for the oil and gas industry. The directors were investigated by the Corrupt Practices Investigation Branch (CPIB) and subsequently charged. The only available evidence against the directors were the confessions they made to the CPIB. The Defence successfully managed to argue that the CPIB officers had procured the confessions of both directors through oppressive means. The Court threw out both confessions and the charges against both were thereafter withdrawn by the prosecution.

PP v Dinesh Rajantheran [2023] SGDC 39 (White Collar – Attempted Bribery)

Mato was lead counsel representing an accused person who faced seven novel and rare charges under section 204B of the Penal Code for abetting the bribery of seven witnesses in judicial proceedings. Mato successfully argued that the Prosecution’s key witness had lied under oath and successfully secured a full acquittal for his client. The decision is reported in Public Prosecutor v Dinesh s/o Rajantheran [2023] SGDC 39.

Bybit Fintech Ltd v Ho Kai Xin & Ors [2023] 5 SLR 1748

Mato acted as part of a team for the Claimant in this seminal decision resulting in the High Court finding for the first time that crypto assets met the definition of ‘property’ and was capable of being held on trust.

Brief facts: The Claimant was the employer of the Defendant. The Defendant during the course of her employment wrongfully transferred crypto assets (USDT) to various accounts belonging to her and/or beneficiaries related to her.

The Claimant commenced legal proceedings against the Defendant, and sought and obtained amongst other things, a declaration of constructive trust over the crypto assets. In reaching its finding, the High Court held that crypto assets meet the definition of ‘property’. This was a seminal decision which has been widely discussed and relied on.
