- Actions for invalidating a will on grounds of undue influence, fraud and lack of testamentary capacity.
- Representing personal representatives of estate in claims made by third parties against the property of the deceased.
- Representing beneficiaries in cases involving interpretation of the will of the deceased.
- Reviewing actions of Executors in the administration of the estate.
- Representing trustees where a dispute has arisen between the beneficiaries and the trustees on how the trust is being administered.
- Actions for removal of trustees or executors where there has been financial mismanagement and conflict of interest.
Non-Contentious Probate
We assist clients in non-contentious matters such as structuring assets for wealth preservation, and obtaining the necessary grants of representation for the assets of the deceased to be accumulated, managed and distributed. Below are some examples of our areas of expertise:
- Assisting the executors in applying for Grant of Probate, in cases where the deceased left behind a valid will.
- Assisting the next-of-kin in applying for Letters of Administration, in cases where there is no will (an intestacy).
- Advising on gifts in the event of intestacy.
